Patrick Boyle

Patrick Boyle is an experienced New York and New Jersey trial attorney, and a member of Venable's New York Litigation Group. Clients seek Patrick's representation and counsel when facing difficult claims and disputes involving insurance coverage, professional liability, and financial cases – particularly mortgage-backed securities. He also advises corporations and individuals in tort liability and insurance claims, and has argued a wide range of complex appellate matters involving securities, banking, tax, lender liability, and catastrophic tort liability issues.

Patrick’s clients include high-profile corporate clients and government entities in the financial, insurance, transportation, maritime, construction, environmental, and manufacturing industries. He has tried over 25 lawsuits and arbitrations to conclusion, for both plaintiffs and defendants, in his home bar states of New York and New Jersey and in numerous other jurisdictions. His legal and other professional experience provides a depth of knowledge in the insurance, transportation, energy, construction, and real estate finance industries, where he has successfully handled cases for and against industry leaders. In addition to his home bar states, he has been retained to handle significant tort liability, securities, and commercial claims for both plaintiffs and defendants in cases pending throughout the United States.

For a decade prior to embarking on his legal career, Patrick was an experienced industrial hygienist and environmental safety professional. He held nine certifications from the New York State Department of Labor and the U.S. EPA for air monitoring and building inspections to determine the presence of asbestos-containing building materials.

Patrick has handled several high-profile plaintiff tort liability actions across the country, including

  • Representing major sports and entertainment venues in their COVID-19 business interruption insurance recovery efforts
  • Represented Companhia Energética Potiguar, a Brazilian operator of power plants, in its litigation against Caterpillar Inc. arising out of the malfunction of 144 generator sets manufactured by CAT; successfully opposed Caterpillar’s motion to dismiss for forum non conveniens and its summary judgment motion, leading to a favorable settlement shortly before trial
  • Represented the Estate of Denise Amber Lee in Florida trial against Charlotte County, Florida
  • Representing numerous policyholders in insurance coverage cases arising out property, liability, crime, computer fraud, fidelity, director and officer and management liability coverages
  • Representing trustees, beneficiaries and other interested parties in several New Jersey based Surrogate and Chancery court proceedings
  • Representing numerous insurance and reinsurance brokers and other insurance intermediaries in subpoena responses and defense of depositions in insurance coverage cases
  • Representing NVOCCs in defense of indemnity claims arising out of General Average and Salvage claims
  • Representing numerous companies in commercial disputes, particularly those concerning insurance or other contractual indemnity obligations
  • Representing companies defrauded by computer or social engineering fraud with insurance coverage and third party liability claims
  • Representing mortgage originators in connection with repurchase demands made by mortgage-backed securities issuers, underwriters and monoline insurers

  • Represented banks and other financial institutions in U.S. Tax Court or Court of Federal Claims tax refund proceedings
  • Represented artist Allen Hirsch in a property damage trial
  • Represented Thacher Proffitt & Wood LLP and its estate in the defense of numerous liability and other claims arising from the statutory dissolution of the firm
  • Represented numerous financial companies in the successful defense of lender liability cases arising out of purported commitments to fund loans (See, e.g., River Glen v. Merrill Lynch, 295 A.D. 2d 274 (1st Dep’t 2002))
  • Represented the State of New Jersey in the prosecution of civil liability cases against 31 defendants arising out of the liquidation of American Preferred Provider Plan, Inc.
  • Represented the City of New York in the successful pro bono defense of five New York City Police Detectives accused of a series of false arrests
  • Represented Battery Park City Authority in its significant first party insurance recovery efforts in the wake of September 11, 2001
  • Represented plaintiffs and defendants in the State and Federal courts of home bar states of New York and New Jersey, as well as in cases in Texas, Louisiana, Kentucky, Ohio, Pennsylvania, Delaware, Washington D.C., Florida and California.
