Anthony Pagano concentrates in construction law and litigation including defect and products liability litigation, claims, commercial litigation and civil trial practice. An aggressive and seasoned litigator, Anthony has successfully represented his clients in motions hearings, trials, depositions, mediations, arbitrations and negotiations across the country. He also has extensive experience in counseling on, drafting, and negotiating contracts for complex multi-million-dollar construction projects, having personally handled nearly $2 billion in domestic and international construction transactions.

He has handled transactions for construction; design; design-build; project management; furniture, fixtures, and equipment (FF&E); and related matters for both new construction and buildout/transition projects in the United States, Canada, the Bahamas, France, Italy, Germany, Portugal, Dubai, Switzerland, and China. He also regularly counsels his clients on construction issues, including contract liability, insurance, damages, warranties, and potential claims.

Anthony has many years of litigation experience from case onset through discovery and trial. His investigatory skills are finely honed, and he possesses a keen ability to recognize and account for critical issues before they develop, which often results in a strategic advantage for litigation clients and assists contract clients in avoiding or anticipating future pitfalls. He brings with him a practical understanding of technical construction matters and industry practices, and an attention to detail which is an asset to his clients in this often highly technical area of the law.

His clients include national hotel developers, national homebuilders, international organizations, a local government, numerous corporate and institutional building owners, and contractors in both the public and private sector, and individuals.

Experience

Representative Matters

  • Representing a prominent national homebuilder against construction defect claims by condominium associations, an international financial organization in connection with a large delay claim involving a prominent government agency, and an international contractor in the establishment of a contracting platform for its government projects
  • Handled a complicated office buildout/transition projects for two prominent international satellite and software platform companies in the DC metropolitan area 
  • Obtained dismissals of claims asserted against his clients in various commercial litigations while successfully representing his clients’ own claims, including claims against the United States Army Corps of Engineers and the General Services Administration 
  • Principal litigator prosecuting and overseeing the development of a nationwide construction and product defect litigation on behalf of a prominent national hotel chain, with tens of millions of dollars in dispute and involving a myriad of construction defect, products liability, and business tort issues
  • As a member of a trial team that included Len Goodman and Greg Brown, tried and won a significant jury verdict in the critical spearhead case of their client's national construction litigation following a six-week jury trial in Massachusetts. The verdict was reported in the October 31, 2005 issue of Massachusetts Lawyers Weekly. This trial team began the second of these jury trials in federal court in Pennsylvania, forcing an extremely favorable resolution of the entire litigation prior to verdict 
  • Along with Carol Elder Bruce, obtained an all-counts "not guilty" jury verdict in a major bribery case against the Maryland Attorney General's Office
